| BY SUBMITTING YOUR ORDER YOU ARE ACKNOWLEDGING THAT YOU HAVE READ THE DISCLOSURES AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS.
By requesting a Consumer Report and/or Public Record Information ("Consumer Report Information") from Tenant Background Search, you agree that the information you provide is true and correct, that 1) You are the person whose Consumer Report and/or Public Record Information is being requested OR 2) You have written authorization granting you the right to request a Consumer Report and/or Public Record Information on someone else's behalf and 3) that you are at least 18 years of age. You understand that by checking the "AGREE" box immediately following this notice, you are providing "written instructions" to Tenant Background Search under the Fair Credit Reporting Act authorizing Tenant Background Search to obtain information from the Consumer Report and/or Public Record Information of the requested person. You authorize Tenant Background Search to obtain such information solely for the purpose of assisting with making a residential or storage leasing decision. Under FCRA laws any person who knowingly and willfully obtains a Consumer Report and/or Public Record Information under false pretenses (for example getting a Consumer Report and/or Public Record Information on an individual without their permission), shall be fined under title 18, United States Code, imprisoned not more than 2 years, or both.
1.If the Consumer has been rejected for credit, insurance or employment in the past sixty (60) days as a result of his or her Consumer Report and/or Public Record Information, the Consumer is entitled to receive a disclosure of the nature and substance of all information in his or her Consumer Report and/or Public Record Information directly from the consumer reporting agency free of charge;
2.The FCRA permits Consumers to dispute inaccurate information in their credit file. Accurate information cannot be changed;
3.The Consumer does not have to purchase the Services or other information or services from Tenant Background Search to dispute inaccurate information in the Consumer Report and/or Public Record Information or to receive a copy of the Consumer's credit report.
4.To dispute information contained in the Consumer Report and/or Public Record Information, the Consumer will contact the credit bureau(s) directly;
5.Credit reporting agencies are required by law to give you a copy of your credit record upon request, at no charge or for a nominal fee.
No Warranty
Tenant Background Search AND THE SITE, INCLUDING ALL CONTENT, CONSUMER REPORT INFORMATION, PRODUCTS AND SERVICES MADE AVAILABLE ON OR ACCESSED THROUGH THIS SITE, ARE PROVIDED TO YOU "AS IS". TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, NEITHER Tenant Background Search NOR ITS AFFILIATES MAKE ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER AS TO THE CONTENT, Consumer Report and/or Public Record Information, PRODUCTS OR SERVICES AVAILABLE ON OR ACCESSED THROUGH Tenant Background Search AND THE SITE, THAT YOU OR A THIRD PARTY WILL HAVE CONTINUOUS, UNINTERRUPTED OR SECURE ACCESS TO Tenant Background Search OR THE SITE, PRODUCTS OR SERVICES OR THAT Tenant Background Search, THE SITE, PRODUCTS OR SERVICES WILL BE ERROR-FREE. IN ADDITION, Tenant Background Search AND ITS AFFILIATES DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND INFORMATIONAL CONTENT. THEREFORE, YOU AGREE THAT YOUR ACCESS TO AND USE OF Tenant Background Search, THE SITE, PRODUCTS, SERVICES AND CONTENT ARE AT YOUR OWN RISK. ADDITIONALLY, YOU AGREE THAT THE Consumer Report and/or Public Record Information THAT Tenant Background Search SHARES WITH YOU IS NOT ERROR-FREE AND MAY INCLUDE INFORMATION THAT DOES NOT PERTAIN TO THE PERSON WHOSE CONSUMER INFORMATION YOU ARE REQUESTING. Tenant Background Search AND ITS AFFILIATES ARE NOT RESPONSIBLE OR LIABLE FOR ANY ACTION OR DECISION TAKEN BY A THIRD PARTY BASED ON THE CONSUMER REPORT INFORMATION. BY USING OUR SITE, YOU ACKNOWLEDGE AND AGREE THAT NEITHER Tenant Background Search NOR ITS AFFILIATES HAVE ANY LIABILITY TO YOU (WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE) FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR ACCESS TO OR USE OF Tenant Background Search, THE SITE, CONTENT, PRODUCTS OR SERVICES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), INCLUDING LIABILITY ASSOCIATED WITH ANY VIRUSES WHICH MAY INFECT YOUR COMPUTER EQUIPMENT. YOU ACKNOWLEDGE AND AGREE that although our nationwide criminal and eviction report's cover a majority of counties throughout the United States, some counties may not be covered in the reports.
Refund Policy
Our reports are based on information obtained from credit bureaus, criminal and eviction data providers. Tenant Background Search makes no guarantees of the accuracy of the reports and therefore does not offer refunds when it comes to data believed to be inaccurate, incomplete or missing. This include reports where a credit score was unable to be provided due to an applicant having insufficient credit data. Applicants should contact the credit bureau if they believe the information the bureau has on file is incorrect. Standard Plus reports and Comprehensive reports are received when the applicants authorize the release of their reports. Once the applicant has authorized the release of their report the lanldord will no longer be entitled to a refund. Standard reports are available to the landlord immediately after placing their order and therefore no refunds are provided for Standard reports under any circumstance. If you were charged for a Standard Plus report or Comprehensive report that the applicant did not authorize the release for you can contact support@tenantBackgroundSearch.com or call 469 729-4768 for a refund. Non-refund questions will not be responded to at this number. Please email support@tenantBackgroundSearch.com for all questions not related to a refund. Please note that it may take up to 1 full business day under normal circumstances for cancellations to be finalized. If an applicant authorizes the release of their report before the cancellation has finalized you will not qualify for a refund.
Report Accessibility
Reports are accessible by logging into your account after the applicant has authorized the release of their report. Reports will remain viewable for 30 days. After 30 days reports will be removed from our server completely and will no longer be accessible.
Trademarks and Copyrights
The trademarks, service marks, and logos used in this web site are registered and unregistered Trademarks. The Trademarks belong to their respective owner including TenantBackgroundSearch.com or TransUnion SmartMove. The Trademark owner has exclusive rights to the Trademarks. Any unauthorized use of the Trademarks is strictly prohibited. You may not display these Trademarks without the specific authorization of the owner.
Force Majeure
TenantBackgroundSearch.com shall be excused from delay in the performance of any obligations hereunder when such delay is the result of or attributable to acts of God, governmental authority, manufacturers delays or any other cause beyond their reasonable control.
Indemnification
Users agree to indemnify and hold TenantBackgroundSearch.com harmless from and against any and all third party claims, demands, actions, losses, liabilities, costs and expenses (including reasonable attorney's fees) arising out of or resulting from the User's (or their affiliates) actions under this agreement. |
